Paul Fleming is the Partner responsible for our Estate and Capacity Litigation group.
Paul brings a great depth of experience and compassion to his clients when managing conflict for individuals who are involved in some of life’s most challenging moments.
He holds three degrees with a B.A. in Political Studies from Queen’s University, an M.A. in Constitutional Law from the University of British Columbia, and finally, an LL.B. from the University of Windsor. Paul practiced as a Crown Attorney with the Ministry of the Attorney General and then with a prominent firm of civil trial lawyers in Vancouver before returning to Ontario. Upon his return, Paul spent many years working as the Principal lawyer at his boutique firm, Fleming Estate Law.
Today, Paul supports Cunningham Swan’s clients with equal levels of expertise and care. Specifically, he provides services related to the following matters:
- Disputes over wills, powers of attorney and trust agreements
- Court applications for guardianship
- Claims for dependent’s support
- Trustee accountability and passing of accounts
- Actions for breach of fiduciary duty
- Actions arising from Elder abuse and Predatory marriage
- Family Law Act (FLA) claims
Paul regularly appears at all levels of court in Ontario and is often invited to speak on diverse topics about estates law, advocacy or the civil justice system in public and at conferences before his peers.
When he is not at work, Paul can be found skiing or sailing alongside his wife, Melinda, his two daughters, Maddy and Sophia, and last but not least- Annika, their Bernese mountain dog.
